A club residency can give you steady income, regular exposure and a stronger name in Atlanta’s music scene. But a rushed agreement can also leave you dealing with unclear pay, surprise schedule changes or limits on other gigs.
Before signing, compare the contract with how the club expects each night to work in real life.
Confirm pay, schedule and work status
Start with the basics. The contract needs to explain when performances happen, how long each set lasts and who controls schedule changes. It also needs clear payment terms, including deposits, tips, cancellation fees and late payments. Look for what happens if the venue closes because of weather, fire, health orders or other events outside either side’s control.
Check how the venue describes your role. An agreement may call you an independent contractor, but worker classification depends on the actual work relationship. Your tax obligations and benefits will change depending on whether you are classified as an employee (W-2) or an independent contractor (1099). Look at who controls your hours, equipment, services and performance requirements.
Review licensing, equipment and liability terms
For public performances, venues often handle music licenses through organizations such as ASCAP or BMI. Still, ask if the club has the needed licenses and whether the contract tries to shift that responsibility to you. Also check if the venue can record your set, livestream it or use clips of your performance in social media promotions without extra approval or pay.
The agreement should also explain who provides sound equipment and who pays if they are damaged. If the venue serves alcohol, review any language that tries to make you responsible for guest behavior, security issues or alcohol-related incidents outside your control.
Look closely at exit and exclusivity terms
Some residency agreements include exclusivity or radius clauses that limit nearby gigs. In Georgia, restrictive terms that apply after an agreement ends must have strict, reasonable limits on time, geographic area and scope. Restrictions active during the residency term face a much more flexible legal standard. Before signing, check whether the clause blocks too many future bookings.
Make the terms work beyond one night
A strong residency agreement protects your income, schedule and reputation. Clear written terms can help prevent disputes once the booking begins. If anything feels unclear or one-sided, ask questions before the first set.
